Tulane University Law Professor Edward Sherman was a source for media reporting on the recent appointment of Judge Priscilla Owen to the United States Fifth Circuit Court of Appeals.
Professor Sherman was quoted in a May 25, 2005 Associated Press article.
"Given Priscilla Owen's record, this appointment would not go toward moderating the decisions of that court," Professor Sherman said. He also noted that it was the Fifth Circuit that "carried the water for the civil rights revolution" in applying to subsequent cases the Brown vs. Board of Education decision, the historic Supreme Court ruling that segregation was unconstitutional. However, he said, the court since has become more conservative on issues such as civil rights, employment, age, sex and race discrimination and affirmative action.
