Tulane University Law Professor Gary Roberts was quoted in the June 23rd edition of USA Today about whether Congress could pass a law requiring steroid testing of major league baseball players.
While Congress is free to pass such a law, Roberts said, there could be challenges on equal protection grounds. According to Roberts, such a law would put athletes in a special class in violation of their constitutional rights.
"Congress can pass such a law," he told the paper. "The question is whether it has the political will and the votes to do so..The biggest impediment to getting a law passed will be turf wars between committees."
