Civil Litigation Ethics Seminar

Course Description
The Model Rules of Professional Conduct contains many areas of uncertainty for litigators. There are specific rules that concern a lawyer’s conduct before a tribunal, both the vast majority of decisions that litigators make must—from deciding to undertake representation through discovery and up to and including trial and appeals—are fraught with ethical questions for which there is little or no guidance in the Model Rules or the case law. This course examines what happens in the “real world” of litigation, includes discussion with leading litigators about how they approach ethical issues, and requires students to address these issues directly in class. Come prepared to be challenged in your thinking and to engage in lively class discussions.  This course is for 3Ls who have already completed the basic course in Legal Ethics. It presumes that the students have an understanding and working knowledge of the ABA Model Rules of Professional Conduct.  Mr. Rubin plans to invoke a rule penalizing students for lack of preparedness and/or excessive absenteeism.  NOTE:  Students can’t take both this course and Professional Responsibility Seminar.    (2 credits)
