| Course Description | | |
This course will be a multi-faceted consideration of the sinking of the oil tanker Prestige off the Northern coast of Spain in November 2002. The incident raised issues of oil pollution liability and response, salvage, places of refuge and government responsibility for refusing refuge, the liability of classification societies, hull and P&I insurance and cargo liability. The law governing each of these aspects of the incident will be considered, both under the international regimes governing the incident itself and (hypothetically) under the US law that would apply if a similar incident occurred in US waters. (3 credits)
